Vallarta Gardens Resort Promotion Terms and Conditions:

Documentation and Qualifications

• Attendance to a 90 to 120-minute sales presentation at Vallarta Gardens Resort Sales Center is required.
• Both qualified participants must present their USA or Canadian passports and be fluent in English. Upon arrival to the resort you will need to present the passports along with the stamped immigration papers confirming your arrival date.
• A major credit card in the name of the qualifying person(s). NO DEBIT CARD, CHECK CARDS OR CORPORATE CARDS WILL BE ACCEPTED - NO EXCEPTIONS!
• Legally Married or Cohabitating (min 3 years) couples must be between 40 and 80 years old when attending the 90-120 minute vacation ownership presentation together at Vallarta Gardens Resort the day after arrival to Mexico, you are required to keep this day free of other obligations. A valid government-issued picture ID that includes their age, same last name, and address as their spouses or a Marriage Certificate will serve as proof. Individuals in the divorce process or separated are not eligible to use this promotional package. Newlyweds must bring their original marriage license or certificate if they do not have matching identification within a 3-month period of their marriage. Both spouses must attend the sales presentation.
• Legally Single Women only who currently own vacation ownership with any other resort and meet the rest of the qualifications.
• Income - Combined or self-annual income of USD 80,000.
• Employment - Must have a steady legally recorded job. Full-time employment only or Retirees with an annual salary or investment income per household equal to at least USD 80,000, part-time does not qualify for this promotion.
• Credit Cards - The single qualifying woman or one of the spouses in a legally married couple must bring and present at least two (2) valid major credit cards in the name of the qualified person(s) at the time of checking into a Hotel or else that person will not be allowed to check into that Hotel, cards such as MasterCard, Visa, Discover or American Express (We do not accept credit cards in the name of a non-qualifying person or corporate credit cards, check cards, extension credit cards, debit cards, and debit cards that also function as credit cards are NOT accepted). Expired credit cards DO NOT QUALIFY.
• Language - Speak and write fluent English and be able to read and sign a legally binding agreement without the help of a translator.
• Fees and tips - There will be a $21.95 per night Resort Fee charged directly by the resort on your welcome call in order to process your resort confirmation number. This fee covers processing and reservation fees, theme nights, daily housekeeping, resort amenities, non-motorized and organized activities, beach towels, fitness facilities, and tips.
• The first night of vacation must be in the sponsoring resort. The following do not qualify for this promotion (Minivac) and therefore will lose their status as Qualified Prospects, resulting in the hotel rack rate payment. a) Students, travel agents, hotel/airline employees, Vallarta Gardens Members, or if you arrive prior to a house, hostel, hotel, or another place whether in Puerto Vallarta or Riviera Nayarit, or if you have, or will attend any other presentation with the same characteristics during the entire length of your stay. b) Acceptance of any other offer to attend any other presentation (airport, street, etc.) c) Group travel is not permitted. A group is considered 2 or more families/associates traveling together on the same travel dates. d) You are not eligible if you have already used a marketing promotion with Vallarta Gardens once in a lifetime. e) If friends and/or family are traveling together with different confirmation numbers, none of them will qualify for the promotional package and will be required to pay the rack rate. f) The omission of information and/or misleading pertinent information regarding group travel may be subject to your reservation being canceled without notice. Vallarta Gardens Resort reserves the right to cancel and/or change your reservation location to an equal or better resort as circumstances so require it. g) You are not eligible if you have previously toured the Vallarta Gardens resort. h) Employees of the Vallarta Gardens (or their family members), relatives of the timeshare industry employees, and timeshare industry-related individuals. Vallarta Gardens Resort reserve the right to alter its terms and conditions and terms of promotions as deemed necessary by operational procedures and/or as otherwise mandated by state or federal laws. This offer supersedes all other representations made regarding this offer, verbal or written, and Vallarta Gardens Resort assumes no responsibility for any verbal or written representations made in conjunction with this offer other than those specifically stated herein. By signing this letter, the participants agree and comply with all terms and conditions mentioned previously. Any verbal or written agreement made that is not contained in this letter is NOT valid. In case of non-compliance with any of the requirements, the reservation will be canceled, so if the participants wish to stay in the hotel, they must pay the rack rate on the understanding that the money paid to the travel agency for the promotion will NOT be taken into account to settle the payment thereof

If the couple fails to attend the required sales presentation or is deemed not qualified by the resort, the full rack rate of the resort will be due at checkout in addition to any amount already paid in advanced.

IMPORTANT NOTE: Participants in the promotion who do not meet the qualifications set forth in the above Details of Participation, including those who fail to attend the sales presentation, will have charged to their credit the current full rack rate of the resort at checkout. Participants with confirmed reservations who fail to check into their reserved accommodations on the first reserved date or who fail to reschedule their reservations AT LEAST TWO (2) WEEKS IN ADVANCE OF CHECK-IN DATE will forfeit the package purchase price. By making a reservation in response to this promotion, you are agreeing to this policy.

OUR SERVICES ARE LIMITED TO MAKING THE RESERVATION TO THE HOTEL OR RESORT YOU SELECTED. ALL INCIDENTALS AND HOTEL/RESORT FEES AND EXTRAS OVER THE BASE FEE OF 4 OR 5 NIGHTS ARE THE GUEST'S RESPONSIBILITY. TAXES ARE THE GUEST'S RESPONSIBILITY, UNLESS INDICATED IN THE PRICE DISCLOSURE. WE ARE NOT RESPONSIBLE FOR THE ACTUAL FULFILLMENT OF THE SERVICES FROM NEITHER THE HOTEL NOR RESORT SELECTED, AND ANY COMPLAINTS SHOULD BE ADDRESSED DIRECTLY WITH THE SERVICE PROVIDER (HOTEL OR RESORT'S FRONT DESK)
